Part A. Learner Terms of Service

A1. Who you are contracting with

These terms are an agreement between you and Will Salisbury, a sole proprietor in British Columbia, Canada, carrying on business as Learning Laboratories and trading as IELTS Laboratory ("we", "us", "our").

By purchasing, registering for, or using any part of the service, you agree to these terms. If you do not agree, do not use the service.

A2. Definitions

The service means the IELTS Laboratory website at ielts-laboratory.co, the learning platform at courses.ielts-laboratory.co, the diagnostic pipeline, the online modules, the discussion board, and any live sessions we run.

A submission means one piece of your writing sent through the diagnostic pipeline and returned to you as a report.

A cycle means one complete pass of the Diagnostic Learning Cycle: a first draft, a diagnostic report, the modules that report routes you to, a second draft on a new question of the same task type, and a comparison report.

A report means the diagnostic document returned to you for a submission.

A teacher code means a unique code issued by us to a registered teacher, which a learner enters to obtain the teacher-referred price.

The book means IELTS Academic Writing Essentials, supplied as a Kindle edition and as a PDF.

A3. What each product includes

All prices are stated and charged in United States dollars. Taxes, where they apply, are added at checkout. Payment is taken through our checkout provider and processed by Stripe. We do not receive or store your full payment card details.

A4. Access period

Access to the online modules, the diagnostic pipeline and the discussion board lasts one month from the date you first access the course, on Essentials, Sprint teacher-referred, Sprint, Sprint Pro and the Sprint Pro Trial.

The book is the exception, and the two parts of Essentials are separate. Your Kindle edition and PDF of the book are yours permanently. The one month period applies only to the online modules, the diagnostic pipeline and the discussion board. Ownership of the book is not affected when access to the online part ends.

When the access month ends, the online modules, the pipeline and the board close. Reports already delivered to you remain yours and you may keep and use them. You should download your reports during your access month.

We do not extend access on request. Where we withdraw or suspend access for a reason that is our fault rather than yours, clause A18 applies.

A5. The free trial

The free trial is two complete diagnostic cycles, one on a line graph task and one on an advantage and disadvantage task. It requires no payment card and carries no obligation. It returns the reports only. The online modules stay locked, and the free trial does not include the book, the discussion board or any live session.

The free trial is offered once per person and covers both cycles. We may decline to run a further free cycle for an email address, a person, or a household that has already used the trial.

A6. What the diagnosis is, and what it is not

Your writing is analysed by an automated system. Every issue it identifies is coded against a fixed taxonomy of fifty codes, and each code routes to the one module that trains it. No person reads your writing as part of producing your report.

The band figures in your report are estimates produced by our system. They are our interpretation of the publicly published IELTS band descriptors. They are not official IELTS scores, they carry no standing with any test provider, university, employer, professional body or immigration authority, and they cannot be used in place of a Test Report Form. Only the official test can tell you your band.

We aim to return a report within minutes of submission, and turnaround is the same at every price. Turnaround is a target and not a term of this agreement.

A7. Submission limits

On Essentials, Sprint teacher-referred, Sprint and Sprint Pro you may have up to twenty-four pieces of writing diagnosed inside the access month, being two per chapter. The Sprint Pro Trial includes one complete cycle. The free trial includes two.

Once you reach twenty-four diagnosed submissions inside the month, the pipeline stops accepting further work from you for that month. Your modules, your reports and the discussion board stay open for the rest of the month. There is no charge for a further submission and no way to buy one. If you reach twenty-four, write to us and we will look at what happened.

We may refuse or stop a submission that is not your own writing, that is not a response to the task set, or that is submitted by an automated tool.

A8. Refunds

You may cancel and receive a full refund within seven days of purchase, provided you have made no more than one submission through the diagnostic pipeline.

Once you have made a second submission, or once seven days have passed, the purchase is final and no refund is available.

You should know that the free trial and this refund window overlap by design. You may run the free trial at no cost, buy a paid tier, make one submission, and still cancel inside seven days for a full refund. That is intended, so that you can test the paid product on your own writing before you commit to it.

The Sprint Pro Trial is refundable on the same terms until the live group session it includes has taken place. After that session it is not refundable, and the $34.99 credit under clause A10 is your remedy.

This clause does not limit any right you have under the Business Practices and Consumer Protection Act (British Columbia) or other consumer protection law that cannot be contracted out of.

Refunds are made to the original payment method. Refunds of a purchase made through a third party store are governed by that store's own terms and are not something we can process. See clause A9.

A9. The book and the redemption code

Where you buy the book from a third party store, that store's terms govern the purchase, the delivery and any return of the book itself.

The book contains a code that redeems one month of access to the online modules and one complete diagnostic cycle. That access is provided by us and is governed by these terms.

The code may be redeemed once. It is tied to the email address that redeems it, and it starts the one month access period on the day it is redeemed. It does not expire before it is redeemed. If you return the book to the store after redeeming the code, the online access ends on the day the return is processed and the book ownership ends with it. The diagnostic cycle you have already used is not refunded, because it has already been delivered.

A10. Sprint Pro Trial credit

The $34.99 Sprint Pro Trial fee is credited in full against the price of Sprint Pro.

The credit applies to a Sprint Pro purchase made within sixty days of the date you bought the Trial. It applies once, to one purchase, and it is not transferable, not redeemable for cash, and not combinable with the first ten places price of $279.99 or with any other reduction. If you do not buy Sprint Pro inside sixty days the credit lapses.

A11. Live sessions

Sprint Pro includes twelve live group sessions, delivered on Microsoft Teams, roughly every second day inside your access month, to a cohort of no more than ten people. Session content is built from the diagnostic data of your own cohort.

Sessions are not recorded and no recordings are supplied. If you miss a session it is not repeated, and no part of the fee is refunded for a session you do not attend.

Session times are published before you buy. We may move a session where we have to, and we will tell you as far in advance as we can. If we cancel a session outright and do not replace it, clause A18 applies.

You may not record, transcribe, photograph or redistribute any part of a live session.

A12. Teacher codes

The $29.99 price is available only with a valid code issued by a teacher we have registered.

When you enter a teacher's code, that teacher can see your diagnostic reports. By entering a code you agree to that. If you do not want your teacher to see your reports, do not enter a code, and buy at the direct price instead.

Codes are issued to a named teacher for the teacher's own students. Codes obtained from any other source, shared publicly, resold, or used by someone who is not that teacher's student, may be cancelled, and we may charge the difference between the price paid and the direct price, or withdraw access.

Your relationship with your teacher is between you and your teacher. We do not employ, supervise, endorse or qualify any teacher, and we are not responsible for the teaching you receive from them.

A13. Your writing, and what we do with it

Your writing remains yours. You keep all rights in it.

You grant us a licence to store your writing and to process it, including sending it to our third party artificial intelligence provider, for the purpose of producing your reports, routing you to modules, comparing your drafts, and operating and improving the service. That licence lasts as long as we hold the writing and is limited to those purposes.

We do not publish any learner's writing, in any public or shared material, without a recorded consent from that learner. Consent is asked for separately, it is recorded, and it is not a condition of using the service. You can decline and everything still works.

Where you do consent, we will tell you at the point of asking which of the two consent tiers you are agreeing to and what each one permits.

We also use aggregated and de-identified data about coded issues and band movement to operate, evaluate and improve the diagnostic method. Aggregated data of that kind does not identify you.

We retain your writing after your access month ends, so that we can compare your drafts and cycles if you return. You may ask us to delete it at any time, and we will.

A14. Our material

The book, the modules, the taxonomy, the diagnostic prompts, the reports, the site and everything else we supply are ours or are licensed to us, and are protected by copyright.

You may use them for your own study. You may not copy, share, publish, resell, sublicense or distribute them, and you may not use them to teach other people, whether or not you charge for it. You may not use them to train, fine tune or evaluate any machine learning model.

Teachers who want to use the material with their own students should register as a teacher under Part B.

A15. Acceptable use

You agree not to:

  • share your account, your login or your access with anyone else

  • submit writing that is not your own

  • use an automated tool to submit work or to extract material from the service

  • attempt to reach parts of the platform you have not paid for

  • post anything on the discussion board that is unlawful, abusive, harassing, discriminatory, deceptive or commercial spam

  • misrepresent yourself as a registered teacher, or represent that we endorse you

The discussion board is moderated. We may remove a post or a member without notice where this clause is broken.

A16. Eligibility

You must be at least sixteen years old to use the service on your own. If you are under sixteen, a parent, guardian or teacher must buy on your behalf and must agree to these terms with you.

You are responsible for keeping your login details secure and for everything done through your account.

A17. Changes to the service

We develop the service continuously. We may change, add to or withdraw modules, prompts, features and the taxonomy at any time.

Where we withdraw something material that you have paid for and are still inside your access month, we will either provide a comparable replacement or refund a fair part of what you paid. That is your remedy in those circumstances.

A18. Suspension and termination

We may suspend or end your access, without refund, where you break clause A14 or clause A15 in a way that is serious or repeated, where you have obtained a price you were not entitled to, or where we are required to by law.

Where we end your access for a reason that is not your fault, we refund the unused part of your access month.

You may stop using the service at any time. Outside the refund window in clause A8, stopping does not entitle you to a refund.

A19. No undertaking about your result

We do not promise, undertake or represent that using the service will produce any particular band score, any improvement in your band score, or any outcome in an official IELTS test. Nothing in the service, on the site, in the book, in a report or in a live session is an undertaking about your result.

Your result depends on your own work, your starting point, the time you put in and the test itself. We provide a method and a diagnosis. We do not provide an outcome.

A20. We are not connected to the test providers

IELTS Laboratory is an independent service. We are not affiliated with, endorsed by, approved by, or connected in any way to the British Council, IDP: IELTS Australia, Cambridge University Press and Assessment, or any other body that owns or administers the IELTS test. Any reference we make to IELTS is a reference to a publicly available examination and its published band descriptors.

We do not set, mark or influence any official test, and nothing we produce has any standing in one.

A21. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited, including rights under British Columbia consumer protection law.

Subject to that, and to the maximum extent the law allows:

  • The service is provided as it is. We do not warrant that it will be uninterrupted, error free, or that any report will be free of error. The diagnosis is automated and may be wrong.

  • We are not liable for indirect or consequential loss, or for lost opportunity, lost application, lost place, lost visa, lost employment, or any cost arising from an official test result.

  • Our total liability to you, for everything arising out of these terms, is limited to the amount you paid us in the twelve months before the claim arose.

A22. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. You and we submit to the exclusive jurisdiction of the courts of British Columbia. Nothing in this clause removes any right you have to bring a claim in the courts of the place where you live, where the law of that place gives you that right and it cannot be contracted out of.

A23. Changes to these terms

We may change these terms. The version in force is the one published on the site on the day you buy. Where we make a material change, we will publish the new version with a new date, and the change applies to purchases made after that date, not to yours retrospectively.

Part B. Teacher Terms

These terms apply to a teacher who registers with IELTS Laboratory and is issued a code. They are in addition to Part A where the teacher also uses the service as a learner.

B1. Registration is free

Registration costs nothing. There is no fee to register, no subscription, and no minimum number of students.

B2. What registration gives you

On registration and verification we issue you one unique code. The code does two things: it unlocks the $29.99 teacher-referred price for your students, and it records that those students came from you.

Registration also gives you access to the discussion board under Part C.

B3. No exclusivity

Registering with us does not stop you working with any other provider, platform, publisher or school, and does not require you to use our material with any student. There is no exclusivity of any kind, in either direction. We do not undertake to send you students.

B4. No commission, and no cut of your teaching

You are paid no commission on anything your students buy. We do not operate a commission on student purchases. If we introduce any payment to teachers in future it will be offered to you in writing as a separate agreement, and it will not be read into these terms.

We never take any share of your own lesson income, at any stage, in any amount. Whatever you charge your students for your own teaching is entirely yours, whether or not those students came to us through your code, and whether or not you found them through anything of ours.

B5. Your code

Your code is issued to you by name and is for use by your own students.

Your code does not expire while it is in use.

We may deactivate a code where:

  • it is published openly, posted publicly, resold, or shared beyond your own students

  • it is being used to obtain the $29.99 price for people who are not your students

  • we cannot verify, or can no longer verify, your identity or your teaching

  • you ask us to

Where we deactivate a code we will tell you and say why. Students who have already bought at the teacher-referred price keep their access.

B6. You can see your students' reports

A student who enters your code is told, at the point of entering it, that you will be able to see their diagnostic reports. On that basis you can see the reports of students who used your code.

That is student data and you must treat it accordingly. You may use it to teach that student. You may not publish it, share it with anyone else, or use it for anything other than teaching that student, and you must stop using it if the student asks you to.

You may not see the reports of any student who did not use your code.

B7. Verification

We verify that you are who you say you are and that you teach. Verification confirms identity only.

Verification is not a qualification, an endorsement, an accreditation or a mark of quality, and we do not present it as one. We do not assess, approve, supervise or stand behind your teaching, and you may not represent that we do. You may say that you are registered with IELTS Laboratory and that you issue our codes. You may not say that we endorse, certify, approve or qualify you.

B8. Using our material

Registration does not license you to reproduce, distribute, adapt or teach from our book, modules or reports as your own material, or to supply them to anyone who has not bought them.

You may use a student's own report with that student in a lesson. That is what it is for.

B9. Ending it

You may stop being a registered teacher at any time by telling us, and we will deactivate your code.

We may end your registration where you break these terms, where verification fails, or where your conduct toward a student or another member gives us reasonable cause. Students who have already bought keep their access.

Part C. Cooperative Terms

The cooperative is the teacher discussion board inside the learning platform.

C1. Membership is free

Membership costs nothing. There is no fee to join and no fee to stay.

C2. You may advertise your own services

You may advertise your own teaching services on the board at no cost. There is no charge for a listing, no charge for placement, and no paid promotion.

C3. We take nothing

We take no commission, fee or share of any work that reaches you through the board. If a learner finds you on the board and becomes your student, whatever they pay you is entirely yours. We do not invoice, we do not deduct, and we do not take a percentage, then or later.

C4. We do not endorse anyone

We do not endorse, qualify, verify, accredit, supervise or recommend any member of the cooperative, and membership is not a mark of quality.

Any arrangement between a learner and a teacher is between the two of them. We are not a party to it. We do not set the price, we do not hold the money, we do not stand behind the work, and we are not liable for it. Disputes between a learner and a teacher are for those two people to resolve.

C5. Conduct on the board

Members must not post anything unlawful, abusive, harassing, discriminatory, deceptive or misleading, must not misrepresent their qualifications or their relationship with us, must not post another member's or another learner's material, and must not post a learner's writing or report without that learner's recorded consent.

We moderate the board and may remove a post or a member without notice.

C6. Ending it

You may leave at any time. We may end your membership where clause C5 is broken.
